Recently one of our clients were subject of an NHS inspection and discovered that the staff did not have the correct level of disclosure. The client had employed several staff who were carrying out 'regulated work' with both children and adults and were not members of the PVG Scheme. We assisted them by providing the application packs, countersigning all the forms and despatching to Disclosure Scotland for process. It transpires that our client had not carried out due diligence and had employed a person who was on the'Barred List' and forbidden to carry out 'Regulated Work'. This is now subject of a Police enquiry and report to the Procurator Fiscal and could result in our client being prosecuted.

Our advice has always been  NEVER ASSUME  ALWAYS CHECK.
